THE CONCEPT OF "VEHICLE" IN THE NEW DUTCH CIVIL LAW ON TRANSPORT BY ROAD

HET BEGRIP "VOERTUIG" IN DE NIEUWE PRIVAATRECHTELIJKE VERVOERWETGEVING

This article considers the scope of the new civil legislation on contracts of transport by road. It points to some uncertainties especially in the field of transport of goods as to whether the new law will be applicable or not; the construction which is used by the legislator seems unsatisfactory for the clear distinction of cases in which the carrier is still liable; for the transport of containers this can be of great importance. For the transport of passengers the author points to some inconsistencies in the new law and the draft of law, still pending in parliament, on public transport of passengers. Consequences for the carrier will exist in the field of its liability; the costs of insurance can be charged according to the changing liability caused by the introduction of this new law. (TRRL)
