CHANGED OR DIFFERING SITE CONDITIONS
This article examines highway specification clauses affecting differing site condition claims and discusses the inconsistent court decisions applying those clauses. The article then suggests means for better protecting the public interest--namely, (1) fair contract terms and (2) early participation by FHWA in cooperation with both the contractor and the highway department in an effort to resolve the contractor and the highway department in an effort to resolve site condition problems in the field and avoid litigation.
