TECHNOLOGY, SOCIETY AND THE FUNCTIONS OF TRAFFIC NOISE LAWS
Both the statutory regulations and the common law relating to traffic noise are examined from a functional perspective. Something of the capacity of the law to address modern tensions between technological developments and the "quality of life" is revealed. In tracing the responses of the legal process to the problem of traffic noise not only the predominant values and interests which influence the content and enforcement of the law are identified, but also the institutional limitations of the applicable law, which are demonstrated by the problem of traffic noise. Both the content and practical problems of enforcement of the relevant legislation are examined, drawing on the Victorian experience. (TRRL)
