DRINK-DRIVING CASES PART 1
The author reports on actual drink-driving cases, cross-referencing them to the provisions of the Road Traffic Act 1972, Sections 5, 6, 7 and 8. Details are given of the interpretation of the compliance with the manufacturers instructions on the storage and use of the breath test equipment. Decisions regarding the definition of "drink or drugs", "attempting to drive", "in charge" and a "public place". The probability of a person not driving while unfit is examined; it must be shown that there was no likelihood of that person driving. A car park of a public house may be a public place during the time it is open to the public and a private place at other times; it is necessary to show that the public have access to it. A constable making a breath test needs to be in uniform, but the test itself has no set pattern to be used and there is no obligation to inform the driver of the reason for the request to provide a specimen of breath.
