REFORM OF THE LEGAL REGULATIONS GOVERNING THE WITHDRAWAL OF A DRIVING LICENCE AND ITS RESTORATION
ZUR REFORM DER GESETZLICHEN BESTIMMUNGEN UEBER DIE ENTZIEHUNG DER FAHRERLAUBNIS UND IHRE WIEDERERTEILUNG
For decades legislation and judgements regarding the confiscation and restoration of driving licences have been contested. This paper deals with judgements and literature regarding the double involvement of the judiciary and the relevant authorities for the confiscation of a driving licence and suggests that paragraph 69 ff.stgb should be struck out and confiscation or restoration of the driving licence should be the responsibility of the relevant administrative authorities only. The author disposes of opposing arguments and makes a critical examination of the results of a symposium organised by the ADAC on this theme as well as leading questions in this field, which were dealt with at the 17th German Traffic Law Congress in 1979 in Goslar.
