Is the STB's Case-by-Case Approach to TIH Regulatory Issues Failing the Public Interest?
This article raises important public policy issues regarding the transport of hazardous materials. Toxic inhalation hazards (TIH), such as anhydrous ammonia and chlorine gas, pose a significant risk to the public in terms of safety and economic loss. Approximately two-thirds of TIH shipments move by rail, but the current regulatory system does not sufficiently deal with issues of aligning costs and risks of TIH rail movement with the interests of TIH shippers and receivers. This article examines the case-by-case approach that the Surface Transportation Board (STB) has taken and how STB regulations remain unchanged. The article concludes with a recommendation for a comprehensive examination of TIH issues and offers suggestions for options that could better serve the public interest.
