Major areas of highway defect tort claims
The goal of this paper is to help highway agencies in focusing more clearly on prevalent highway safety problems. The paper presents the five most common categories of highway defects that are the subject of tort litigation in the United States. The paper provides a discussion of prevailing highway safety philosophies, authoritative documents, and legal responsibilities of highway agencies. The topics addressed for each highway defect category are: the elements of hazard; the prevailing standards; the character of typical tort claims; and the key references.
