CLEAN AIR ACT: ANALYZING THE AUTOMOBILE INSPECTION, WARRANTY, AND RECALL PROVISIONS
THIS ARTICLE OFFERS AN ANALYSIS OF THE DIFFICULTIES OF USING THE REGULATORY POWERS DELEGATED BY THE CLEAN AIR ACT FOR ACHIEVING THE REDUCTION OF MOTOR VEHICLE EMISSIONS. STATUTORY PROVISIONS FOR STATE VEHICLE INSPECTION RECALL INITIATED BY THE EPA, AND MANUFACTURER WARRANTY OF EMISSION LEVELS APPEAR TO PROVIDE CRUCIAL INCENTIVES FOR REALIZING THE ACT'S TECHNICAL AND ENVIRONMENTAL GOALS. ALTERNATIVES TO THE PRESENT STATUTORY SCHEME ARE DISCUSSED UNDER INNOVATION TO OVERCOME IMPLEMENTATION PROBLEMS, AND REVISION OF TECHNOLOGICAL GOALS.
