Putting Words into Deeds

This article describes the National Land Transport Act (NLTA), passed by the South African Parliament in 2009 and signed into law with regulations in 2010. The NLTA defines the roles and functions of three spheres of government in relation to transport: national and provincial governments are tasked with strategic, regulatory, and coordinating functions, while local government is responsible for managing the operational components of public transport. The NLTA also requires that provinces disband their operating licensing boards and replace these with bodies called Provincial Regulatory Entities (PREs), which are staffed by public servants. This results in a tightening-up of how operating licenses are granted to the minibus, bus, and taxi industry, limiting the potential for overtrading and conflict over routes. The author briefly reports on the experiences of some municipalities, including the cities of Cape Town and Mangaung.
