ACTION STRATEGIES AND ENVIRONMENTAL VALUES - CONSERVATION: AN OVERVIEW
ACTION PROGRAMS WHICH REFLECT A BALANCE BETWEEN ECONOMIC GROWTH AND THE ASPIRATIONS OF THE COMMUNITY TO MAINTAIN THEIR ENVIRONMENTAL QUALITY ARE REVIEWED. LEGISLATIVE EFFORT WAS MADE TO MODERNIZE OR ENACT LAWS COVERING LAND USES, AND TO RECOGNIZE THE EXECUTIVE BRANCH TO ENABLE COORDINATED AND BALANCED ADMINISTRATION. STATE CONTROL WAS ASSERTED OVER MOBILE-HOME PARKS AND CAMP GROUNDS. THE WATER QUALITY LAW WAS REVISED AND NATURAL RESOURCE PROGRAMS AND THEIR ADMINISTERING DEPARTMENTS, WERE TRANSFERRED TO THE NEWLY CREATED AGENCY OF ENVIRONMENTAL CONSERVATION. LAND DEVELOPMENT CONTROLS ARE DISCUSSED. LEGISLATIVELY, THE MOST SIGNIFICANT ACTION WAS THE PASSAGE OF THE LAW OR ACT UNDER WHICH STATE CONTROL IS ASSERTED OVER VIRTUALLY ALL LAND DEVELOPMENT ACTIVITIES. ALTHOUGH IT IS IMPOSSIBLE TO ACCURATELY SUMMARIZE THE JURISDICTIONAL PROVISIONS OF THE LAW, THE LAND USES WHICH REQUIRE PERMITS ARE LISTED. CRITERIA UNDER WHICH A PROJECT IS REVIEWED ARE CATEGORIZED THUS: NATURAL RESOURCES CAPABILITY; LONG-RANGE RESOURCE UTILIZATION; AND HUMAN RESOURCE CAPABILITY. THE PRINCIPLE FUNCTIONS (ADMINISTRATIVE; REGULATORY; QUASI-JUDICIAL; PLANNING; ENFORCEMENT) OF THE NINE MEMBER ENVIRONMENTAL BOARD CREATED BY THE ACT ARE REVIEWED. THE ROLE PLAYED BY THE ENVIRONMENTAL CONSERVATION AGENCY IS OUTLINED AND EXPERIENCES RELATED TO THE SITUATION IN VERMONT ARE DISCUSSED.
