      <title>Die EG-Richtlinie zur Bewertung und Bekaempfung von Umgebungslaerm / The European Directive relating to the assessment and management of environmental noise</title>

      <description><![CDATA[Mit der Veroeffentlichung im Amtsblatt der Europaeischen Gemeinschaften ist die "Richtlinie des Europaeischen Parlaments und des Rates ueber die Bewertung und die Bekaempfung von Umgebungslaerm" in Kraft getreten. Die Europaeische Gemeinschaft hat damit erstmalig eine rechtliche Regelung hinsichtlich der Geraeuschimmissionen in der Umwelt erlassen. Die Richtlinie soll ein gemeinsames Konzept festlegen, um schaedliche Auswirkungen, einschliesslich Belaestigung, durch Umgebungslaerm zu verhindern, ihnen vorzubeugen oder sie zu mindern. Sie soll weiterhin eine Grundlage fuer die Einfuehrung von Gemeinschaftsmassnahmen zur Laermminderung bei den wichtigsten Laermquellen darstellen. Die Anforderungen der Richtlinie werden vorgestellt und erklaert, und es werden erste Ansaetze fuer ein Umsetzungskonzept dargestellt. (A) ABSTRACT IN ENGLISH: The "Directive of the European Parliament and of the Council relating to the assessment and management of environmental noise" has been published in the Official Journal of the European Communities and thus entered into force. The aim of this Directive shall be to define a common approach intended to avoid, prevent or reduce the harmful effects, including annoyance, due to exposure to environmental noise. It shall also aim at providing a basis for developing Community measures to reduce noise emitted by the major sources. The requirements of the Directive are presented and discussed and first ideas concerning the transposition in national legislation are given. (A)]]></description>

      <title>EL PROYECTO DE LEY REGULADORA DEL CONTRATO DE CONCESION DE OBRAS PUBLICAS</title>

      <description><![CDATA[Con motivo de la reciente remision por el Gobierno al Congreso de los Diputados del Proyecto de Ley Reguladora del Contrato de Concesion de Obras Publicas, se efectua un estudio general de la figura juridica del Contrato de Concesion de Obra Publica que incluye sus antecedentes historicos en Espana, la legislacion actualmente vigente que lo contempla y los elementos fundamentales que caracterizan el concepto actualizado de Concesion de Obras Publicas que se recoge en el citado Proyecto de Ley. En este sentido, se profundiza en las conclusiones ofrecidas sobre la materia por la Comunicacion Interpretativa de la Comision Europea 2000/C 121/02, publicada en el DOCE de 29 de abril de 2000 y, siguiendo el nuevo Proyecto de Ley, se analizan los derechos y deberes de los concesionarios de obras publicas, asi como las prerrogativas del organo de contratacion correspondiente. Todo ello con el doble objetivo de lograr una mayor certeza y claridad del marco juridico general regulatorio que, a su vez, estimule la inversion del sector privado en la construccion de las obras publicas previstas en el Programa de Infraestructuras de Transportes 2000-2002 que el Gobierno espanol esta acometiendo por considerarlo necesario para la convergencia real de Espana con el resto de los paises mas desarrollados de la Union Europea. (A). Resumen en ingles: The article provides a general overview of the legal nature of Public Works Concession Contracts in the light of the Bill on the same recently submitted to Parliament. The article considers the historical background of these concessions in Spain, the current legislation covering the same and the basic elements characterising the updated concept of Public Works Concessions according to the said Bill. The author also reflects on the conclusions reached in the European Commission's Interpretative Communication on Concessions under Commumty Law 2000/C 121/02, published in the Official Journal of the European Communities on 29 April 2000, and analyzes the rights and obligations of public works concessionaires in accordance with the new Spanish Bill as well as the prerogatives of the corresponding contracting bodies. The dual objective of all this is to ensure greater certainry and clarity regarding general legislation which shall, in turn, stimulate privóte investment in the construction of the public works established in the 2000-2002 Transport Infrastructure Programme. This programme having been undertaken by the Spanish Government ¡n order to obtain the real convergence of Spain with the rest of the more developed countries in the European Union.       <description><![CDATA[The amendment is designed to ensure that any replacement exhaust system, that can differ from the original equipment, meets the technical requirements and checks laid down at Community level. Provisions on exhaust units in the original EEC Directive 78/1015/EEC for the original complete system are amended to so that individual separate technical units meet the same requirements.  A new type- approval certificate will be issued.  Member States can prohibit the sale, registration or use of motorcycles whose exhaust system (or part of that system) do not comply with the provisions of the Directive. The regulations apply to all the individual national type-approval requirements of the member states.]]></description>

      <description><![CDATA[This Council Directive amends Directive 88/77/EEC on the approximation of the laws of the member states relating to the measures to be taken against the emission of gaseous pollutants from diesel engines for use in vehicles.  The Directive aims to reduce the limits previously set for levels of carbon monoxide, unburnt hydrocarbons and nitrogen oxides as a result of technical progress and anticipated traffic increases.  Member states are empowered to refuse approval to engines not complying with the levels, to provide tax incentives and to bring into force any necessary legislation.  Details of amendments to Annexes I, II, III, V and VIII covering definitions, test procedure, conformity of production, analytical and sampling systems and the EEC type-approved certificate are provided in an appendix.]]></description>

Statistics are provided for the number of projects and studies being undertaken by European countries, the number completed or delayed and costs to the EEC (December 1991).  Concern is expressed over current monitoring and procedures. Coordination between the various parties is discussed and guidelines for future projects suggested.
