FEDERAL DESIGN-BUILD REGS LIMIT INNOVATIVE CONTRACTING
Increasingly, public agencies are relying on design-build and public-private partnerships as tools to accelerate delivery of and obtain financing for needed transport infrastructure. The Federal Highway Administration (FHWA), through its recently published final rule on Design-Build-Contracting, has succeeded in expanding the potential for use of these tools in certain respects but, unfortunately, has also placed significant limitations on the ability of state and local agencies to use them. This article discusses the potential implications of this new FHWA rule for transport-related contracting and procurement, which was adopted for the purpose of implementing federal legislation enacted in 1998 as part of TEA-21.
