FHWA RELAXES NEPA STANDARD ON RFPS, FOR PUBLIC-PRIVATE PARTNERSHIPS
The Federal Highway Administration (FHWA) recently issued a letter to the Virginia Department of Transportation (VDOT) establishing a significant exception to FHWA's previously stated policies relating to National Environmental Policy Act (NEPA) procedures as set forth in late 2002. Although not directly applicable to other projects, FHWA's guidance to VDOT on its I-81 Project should pave the way for other state and local highway agencies to proceed with their plans to engage private developers in advance of a record of decision under NEPA and to involve them in the NEPA process. The article further discusses this topic in some detail, citing an additional example in southern California.
